Before diving into our website or services, please take a moment to familiarise yourself with our Terms & Conditions. By accessing or using our service, you're acknowledging and agreeing to the terms outlined here. Remember, My Studio Website's liability is capped at the amount you've paid us for our services.

Engagement Terms

Payment Structure: Our payment plan for website projects is split into two key stages:

• Initial Stage: We require a 50% deposit before we kick off your project.
• Completion Stage: The remaining 50% is due before your website's launch, which includes setting up your subscription details with Squarespace, Wix or Website.im.

Refund Guidelines:

• Before We Start: If you change your mind before we begin, you're entitled to a full refund of your deposit, provided you let us know in writing.
• After We Start: Once we've begun work on your project, the initial deposit is non-refundable.
• Post-Launch: If you decide to step back after the website goes live, we're unable to offer a refund. Exceptions are made for significant discrepancies between our delivery and what was promised or provided for inclusion on the site. We'll address any such issues promptly and reserve the right to finalise payment once resolved.

Project Pause: If we're waiting on your feedback or approval and don't hear back within 4 weeks, we may need to pause your project. To restart, there's a fee of $100 + GST to cover rescheduling. Projects on hold for over three weeks risk permanent closure, with all payments forfeited.

Imagery Use: Stock images used on your site remain the property of their respective owners and can't be reused elsewhere. This doesn't apply to your own images or any royalty-free images we've sourced for you.

Ownership and Rights: Squarespace Wix or Website.im owns the platform and underlying code of your website. Once you've settled the full project payment, you own the website's design, style, and all the content you've added.

Content Policy: We steer clear of hosting or transmitting content that's sexually explicit, malicious, infringing on copyrights, or otherwise illegal or deceptive on websites we create.

Pricing Agreement: The price we agree on before starting your project is final, barring unforeseen necessities for additional charges, which we'll discuss with you first.

Non-Payment: Outstanding balances may lead to debt recovery actions, which would be at your expense.

Using Your Site for Promotion: We reserve the right to showcase your website in our portfolio and marketing efforts.

Support After Launch: We offer basic technical support and updates post-launch. More complex additions or changes may incur extra charges.

Ongoing Support: Our monthly maintenance package ensures your site remains in top shape, with no obligation to continue; you can cancel anytime with written notice.

Launching Your Site: We aim to launch your site as per your schedule, though we can't guarantee exact dates. We'll communicate openly about any necessary adjustments.

Your Privacy Matters: We value your privacy as much as you do and will protect your information, only disclosing it when legally required.

Fair Use: We expect all our clients to use our services responsibly. Failure to do so may lead to termination of services.

Our Website Usage: Feel free to browse our site, but please don't alter any content without our express written permission.

Website Hosting: Our sites are hosted on Squarespace, wix or Website.im, adhering to their service terms.

Limitation of Liability: Our responsibility for services rendered is strictly limited to the terms stated here.

Warranty Disclaimer: We provide services "as is," with warranties only as required by law.

Severability: Should any term here be deemed unenforceable, the remainder still applies.

Dispute Resolution: We aim to resolve disputes amicably through negotiation and, if needed, mediation or arbitration following The Institute of Arbitrators & Mediators Australia's guidelines.

Jurisdiction: These terms are governed by New South Wales law, and any disputes will be resolved within this jurisdiction.
